Terms & Conditions

Enrolment, fees, classes and general use of our services

1. About These Terms

These Terms & Conditions (“Terms”) govern your use of the educational services offered by The Learning Pro, a coaching institute operating from Kolkata, West Bengal, India. By enrolling a student or using our services — whether offline at our centre or online — you (“Parent / Guardian / Student”) agree to be bound by these Terms in full.

These Terms are governed by the laws of India, including but not limited to the Consumer Protection Act, 2019 and applicable state regulations of West Bengal.

2. Enrolment & Registration

Enrolment is confirmed only upon receipt of the registration form and the applicable fee payment. The Learning Pro reserves the right to accept or decline any enrolment application without providing a reason. Seats are allocated on a first-come, first-served basis and availability is not guaranteed.

  • A student must be enrolled by a parent or legal guardian if below 18 years of age.
  • Accurate details — name, class, school, address, and contact number — must be provided at the time of registration.
  • The Learning Pro is not responsible for loss of services arising from incorrect information provided during registration.
  • Enrolment in one programme does not automatically entitle the student to any other programme.

3. Fees & Payment

All course fees are payable in advance as per the fee schedule communicated at the time of admission. Fees may be revised at the beginning of a new academic term, and enrolled families will be notified at least 15 days in advance.

  • Fees are non-transferable between students or programmes.
  • Payments made via bank transfer, UPI, or cash must be accompanied by an official receipt issued by The Learning Pro.
  • A late payment charge may apply for fees not settled within the due date as specified in your fee schedule.
  • Outstanding fees may result in suspension of access to classes, study materials, and online resources.

All fee-related disputes must be raised in writing within 7 days of the payment date. Disputes raised after this period may not be entertained.

4. Class Schedule & Attendance

Class timings are communicated at the time of enrolment. The Learning Pro reserves the right to reschedule or cancel classes due to public holidays, unforeseen circumstances, or faculty unavailability. Rescheduled classes will be communicated via WhatsApp or phone call with reasonable notice.

  • Regular attendance is expected and is the responsibility of the student and parent/guardian.
  • No compensation or class credits are provided for classes missed by the student unless the class was cancelled by the institute.
  • Students missing more than 50% of scheduled classes in a month without prior intimation may be removed from the batch.

5. Modification of Services

The Learning Pro reserves the right to modify, suspend, or discontinue any programme, batch, or service at any time with reasonable prior notice. In the event of programme discontinuation, a proportionate fee refund will be issued as per our Refund Policy.

6. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of the courts in Kolkata, West Bengal.

Privacy Policy

How we collect, use and protect your personal information

1. Our Commitment

The Learning Pro is committed to protecting the privacy of all students, parents, and guardians who share their personal information with us. This Privacy Policy explains what information we collect, how we use it, and the measures we take to keep it safe. This policy is compliant with the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023 (India).

2. Information We Collect

  • Personal Details: Student name, date of birth, class, school name, address, parent/guardian name.
  • Contact Information: Mobile numbers and WhatsApp numbers of parent/guardian.
  • Academic Information: Performance records, test scores, progress reports, and attendance.
  • Payment Information: Fee payment records (we do not store card or banking credentials).
  • Communication Data: Messages or queries sent to us via WhatsApp, phone, or our website contact form.

3. How We Use Your Information

  • To process enrolment and maintain student records.
  • To communicate class schedules, fee reminders, and academic updates.
  • To share progress reports and performance feedback with parents/guardians.
  • To send important notices regarding our programmes and services.
  • To improve our teaching methods and course structure based on academic data.

We do not sell, rent, or share your personal data with any third party for commercial or marketing purposes under any circumstances.

4. Data of Minors

Since a significant portion of our students are minors (below 18 years), all personal data of minors is collected only through and with the consent of a parent or legal guardian. Parents have the right to access, correct, or request deletion of their child’s data at any time by contacting us.

5. Data Security

We take reasonable technical and organisational steps to protect your information from unauthorised access, disclosure, or misuse. Student records are maintained securely and access is restricted to authorised staff only.

6. Retention

Personal data is retained for as long as the student is enrolled and for a period of up to 2 years after the completion of enrolment, for legitimate administrative purposes. After this period, data is securely deleted or anonymised.

7. Your Rights

  • Right to access the personal data we hold about you or your child.
  • Right to correct inaccurate information.
  • Right to request deletion of data (subject to legal and administrative obligations).
  • Right to withdraw consent for marketing communications at any time.

Refund & Cancellation Policy

Fee refunds, withdrawals and cancellation conditions

1. General Policy

The Learning Pro follows a fair and transparent refund policy. All refund requests must be made in writing — via WhatsApp message or in person at our Kolkata centre — and will be processed based on the conditions stated below.

Registration fees and processing charges, if applicable, are strictly non-refundable under all circumstances.

2. Refund Schedule

  • Cancellation before batch start date: 90% of tuition fee refunded. 10% retained as administrative charge.
  • Cancellation within 7 days of batch commencement: 75% of the remaining tuition fee refunded.
  • Cancellation between 8 to 15 days of commencement: 50% of the remaining tuition fee refunded.
  • Cancellation after 15 days of commencement: No refund will be issued for the ongoing month’s fee.
  • For monthly fee plans: No refund is applicable for a month in which the student has attended at least one class.

3. Study Materials

Fees paid for printed study materials, workbooks, or practice papers are non-refundable once the material has been issued to the student.

4. Institute-Initiated Cancellations

In the rare event that The Learning Pro discontinues a batch or programme after commencement, students are entitled to a full pro-rated refund of the unused portion of fees paid, calculated from the date of discontinuation.

5. Online Classes

For online sessions, if a student misses a live class without prior notice, no refund or make-up class is guaranteed. However, we may provide recorded sessions at our discretion for valid reasons (medical emergency, etc.) with prior communication.

6. Refund Processing

Approved refunds are processed within 10–15 working days from the date of approval. Refunds will be issued via the same payment mode used at the time of fee payment (bank transfer / UPI / cash). The Learning Pro does not charge any additional fee for processing refunds.

7. How to Request a Refund

  • Provide your original payment receipt for verification.
  • All requests are reviewed within 3 working days and you will be informed of the decision.

Parental Responsibility & Student Code of Conduct

Expected behaviour, responsibilities and disciplinary guidelines

1. Purpose

The Learning Pro believes that a safe, respectful, and focused learning environment is the foundation of academic success. This policy outlines the responsibilities expected from students and their parents or guardians to help us maintain that environment for every child enrolled with us.

2. Student Responsibilities

  • Arrive on time for every scheduled class — offline or online.
  • Carry all required books, stationery, and study materials to every class.
  • Complete all assigned homework, practice papers, and revision tasks sincerely.
  • Treat all tutors, staff members, and fellow students with respect and courtesy.
  • Maintain silence and focus during class and avoid using mobile phones unless directed by the tutor.
  • Refrain from any form of bullying, abusive language, or disruptive behaviour during sessions.
  • Inform the tutor or the institute in advance if unable to attend a scheduled class.
  • Take care of institute property and compensate for wilful damage.

3. Parental / Guardian Responsibilities

Parents and guardians are active partners in a student’s academic journey. The Learning Pro expects the following from parents throughout the enrolment period:

  • Ensure the student attends classes regularly and punctually.
  • Monitor the student’s homework completion and overall academic engagement at home.
  • Stay in regular communication with the tutor to understand the student’s progress and challenges.
  • Inform the institute promptly of any medical condition, emotional concern, or home situation that may affect the student’s learning.
  • Treat all tutors and institute staff with respect. Aggressive, threatening, or abusive conduct towards staff will not be tolerated and may result in immediate termination of enrolment.
  • Ensure fees are paid on time as per the agreed schedule.
  • Do not request private contact details (personal phone numbers or social media) of tutors or staff members.
  • Feedback and concerns should be raised respectfully through official communication channels only (WhatsApp to institute number).

The Learning Pro has a zero-tolerance policy for any form of harassment, abuse, or intimidation directed at our tutors or staff by parents, guardians, or students.

4. Online Class Conduct

  • Students must join online sessions from a quiet, distraction-free environment.
  • Camera must be kept on during live sessions unless a genuine technical constraint exists.
  • Recording of any online session without explicit written permission from The Learning Pro is strictly prohibited.
  • Sharing of class links, recorded content, or study materials with unauthorised persons is not permitted.
  • Parents/guardians should not interfere or interrupt during live sessions unless it is an emergency.

5. Mobile Phone & Device Policy

During offline classes, students are required to keep mobile phones switched off or on silent mode and stored away. For online classes, students should use a dedicated device for the session and avoid switching to other applications during class hours.

6. Disciplinary Action

In cases of repeated misconduct, The Learning Pro reserves the right to take the following actions:

  • Verbal warning issued by the tutor for first-time minor misconduct.
  • Written notice to the parent/guardian for repeated or serious misconduct.
  • Temporary suspension from classes pending a review meeting with parents.
  • Permanent termination of enrolment for severe or continued misconduct, including bullying, harassment, or violent behaviour. Fees for the remaining period will be refunded on a pro-rated basis.

The decision of The Learning Pro management regarding disciplinary matters shall be final. The institute is not liable for any academic disruption arising from disciplinary action taken in the student’s interest and the interest of the batch.

7. Social Media & Reputation

Students and parents are requested not to post misleading, defamatory, or false reviews or content about The Learning Pro or its tutors on any public platform. Genuine grievances must be communicated directly to the institute for prompt resolution before being escalated externally.

8. Acknowledgement

By enrolling your child at The Learning Pro, the parent/guardian acknowledges having read and agreed to this Parental Responsibility & Student Code of Conduct Policy and agrees to uphold its terms for the full duration of the enrolment.

Limitations of liability and general academic disclaimers

1. No Guarantee of Results

The Learning Pro provides coaching and academic guidance to the best of its ability. However, we do not guarantee specific academic results, marks, grades, board scores, or selection in any entrance examination. Academic outcomes depend on a combination of factors including the student’s effort, consistency, individual ability, home environment, school curriculum, and examination conditions — many of which are beyond the control of the institute.

Any statistics, success rates, or testimonials shared on our website or marketing materials are indicative of past performance and must not be construed as a guarantee of future results.

2. Accuracy of Information

While we make every effort to ensure that information on our website, brochures, and social media is accurate and up to date, The Learning Pro makes no warranties — expressed or implied — regarding the completeness, accuracy, or reliability of such information. Course details, fees, batch timings, and faculty are subject to change. Always confirm current information directly with our team before making any decisions.

3. Third-Party Links & Content

Our website or communications may occasionally contain links to third-party websites or resources (such as government examination portals or educational boards). These links are provided for convenience only. The Learning Pro does not endorse or take responsibility for the content, accuracy, or privacy practices of any third-party website.

4. Health & Safety

Students attend offline classes at their own risk in terms of general health and safety. The Learning Pro takes reasonable precautions to maintain a safe learning environment but is not liable for personal injury, illness, or loss of belongings on the premises, except where directly caused by negligence on the part of the institute.

During periods of health emergencies, natural calamities, or government-mandated restrictions, The Learning Pro reserves the right to shift classes to online mode or suspend operations temporarily without financial penalty to the institute beyond the proportionate refund of unused fees.

5. Intellectual Property

All study materials, notes, practice papers, question banks, and content created or distributed by The Learning Pro are the intellectual property of the institute. Students and parents are not permitted to reproduce, share, upload, distribute, or sell these materials without prior written consent. Violation of this may result in legal action under applicable Indian intellectual property laws.

6. Limitation of Liability

To the maximum extent permitted by applicable law, The Learning Pro, its tutors, and staff shall not be liable for any indirect, incidental, or consequential loss or damage arising out of or in connection with the use of our services, including but not limited to loss of academic opportunity, mental distress, or financial loss, except in cases of proven gross negligence or wilful misconduct by the institute.

7. Changes to Legal Policies

The Learning Pro reserves the right to update or modify any of its legal policies at any time. The revised policies will be published on our website and communicated to enrolled families via WhatsApp. Continued enrolment after the effective date of any policy change constitutes acceptance of the updated terms.
